Общественное воздействие как средство исправления осужденных: к вопросу о дефинировании в контексте сравнительно­‑правового анализа

Abstract

Goal – improving the legal regulation of social influence as a means of correction of convicted persons; expansion of forms of social influence as a means of correction; resocialization and re­‑adaptation in civil society of persons convicted of imprisonment. Research methodology – the object of the study is public relations that arise during using social influence as a means of correction on convicted persons sentenced to imprisonment. Subject of research: norms of criminal, penal legislation, other rules of law governing the social influence on prisoners sentenced to imprisonment; theoretical provisions and scientific views on the issue of the effectiveness of using means to achieve the goals of criminal responsibility. In the research process, a systematic approach was used, as well as a method of legal modeling, historical, logical, statistical and comparative legal methods. Score/results – the determination of the content of social influence on persons sentenced to deprivation of liberty as one of the means of their correction will make it possible to establish its place in the system of fixed assets to achieve the goals of criminal responsibility, applied in accordance with the criminal­‑executive legislation of the Republic of Belarus. Possibility of increasing the level of social re­‑adaptation and re­‑socialization of convicts serving sentences related to the strict isolation of convicts from society through the use of civil society institutions. Originality/value – the article emphasizes the need to supplement of Criminal Code of the the Republic of Belarus with regulations allowing the participation of representatives of civil society in the resocialization of convicts.
