Abstract

The concept of place of residence is a significant term of legal language, which is used in many acts. In each of them, however, it may have a slightly separate meaning, taking into account the purpose and function of a given regulation. The provisions of the Act on Agricultural Property Management and the Act on Shaping the Agricultural System refer to the place of residence as a condition for qualifying as an individual farmer and admission to a restricted tender to the purchase of an agricultural property. As proof of this circumstance, however, the Act sets out a document confirming the permanent residence registration. In the opinion of the Supreme Court, the comparison of these regulations leads to the interpretation that the place of residence within the meaning of the aforementioned acts should be identified with the place of permanent residence, in accordance with the Act on the Population Registry. This view can be questioned on theoretical grounds, however, it is of great importance in the practice of applying the law.
