Profile pojęcia 'godność' w Konstytucji Rzeczypospolitej Polskiej

Abstract

W artykule zaprezentowano wyniki analizy semantycznej nazwy „godność” występującej w aktualnej polskiej Konstytucji. Z tekstu źródłowego wyekscerpowano połączenia wyrazowe, w jakie wchodzi leksem „godność” i na ich podstawie wskazano trzy profile znaczeniowe pojęcia godności: ‘godność osobową’, „godność Narodu’ i ‘godność urzędu’. Poszczególne profile badanego pojęcia są w ustawie zasadniczej charakteryzowane zgodnie z punktem widzenia prawodawcy. ‘Godność osobowa’ zyskuje w dokumencie cechy przyrodzoności, niezbywalności i nienaruszalności. Ponadto jest ona źródłem praw i wolności człowieka. ‘Godność Narodu’ jest wartością chronioną przez Prezydenta Rzeczypospolitej, na co wskazuje treść wygłaszanej przez niego przysięgi. Ten profil pojęcia nie został w ustawie zasadniczej precyzyjnie określony. Domyślać się można, że wiąże się on z tożsamością narodową, tradycją i kulturą etniczną. ‘Godność urzędu’ odnosi się natomiast do ważnych funkcji państwowych sprawowanych przez polityków. Wskazuje na szacunek wobec powierzonych im obowiązków. Konstytucyjna semantyka nazwy „godność” została zestawiona z definicjami publikowanymi w wybranych słownikach języka polskiego. Porównanie to ujawniło, iż tylko jeden z konstytucyjnych profili pojęcia ‘godność’ (‘godność osobowa’) ma odzwierciedlenie w opisach leksykograficznych. Pozostałe dwa nie są w nich reprezentowane. W konkluzji wskazano potrzebę włączenia prawnych znaczeń nazwy „godność” (oraz innych terminów normatywnych) w zakres definicji słownikowych. Ułatwiłoby to, być może, zrozumienie komunikatów prawnych przez przeciętnych użytkowników polszczyzny.

The article presents a semantic analysis ‘dignity’as the name of a constitutional value. Lexical phrases containing the unit ‘dignity’ were found in the source text (i.e. the currently binding Polish Constitution) and then studied in terms of contexts in which they appear. This process resulted in three semantic profiles of the concept under study: the ‘personal dignity’, the ‘nation’s dignity’ (i.e. dignity of the people) and the ‘dignity of the office’. The characteristics of the particular profiles of the concept under scrutiny seems to reflect the point of view of the legislator. The ‘personal dignity’ assumes the qualities of inherence, inalienability and inviolability (sanctity). It is also the source of human rights and freedom. The ‘nation’s dignity’ is a value that is protected by the President, which is indicated by the text of the presidential oath; this profile is not overtly and precisely defined in the Constitution, but one may guess that it relates to the questions of national identity, tradition and ethnic culture. The ‘dignity of office’, on the other hand, is connected with crucial state offices held by politicians and implies respect for the responsibilities vested in them. The semantics of ‘dignity’ characterizing the Constitution was compared to selected dictionary definitions. This revealed that there is only one constitutional profile (namely, the ‘personal dignity’) that is reflected in lexicographic descriptions. Interestingly, the remaining two profiles are not represented in dictionaries. The paper concludes with the need that legal meanings of ‘dignity’ (along with other normative terms) should be included within the scope of dictionary definitions. This may probably facilitate the comprehension legal messages by ordinary, folk users of the Polish language.
