| Abstrakt: | In November 1918 Poland, after more than 120 years of occupation, regained its independence. The new - established State (so - called Second Republic) had to build up its new own legal system. In order to do it, The Codification Commission was established in 1919. This institution was basically to prepare projects of new penal and civil laws, but also it was designated to prepare laws concerning court's system. The other centers of these works were located in the Ministry of Justice and in the Parliament (Sejm). As a resuIt, in 1928 the President passed a decree called The Common Court of Law Act (Prawo o ustroju sądów powszechnych). The article presents view that this act was constructed both by the Codification Commission and the Ministry of Justice. The role of Sejm was also important, because parliament passed the Constitution in March 1921, which regulated the general shape of Polish courts system. |
