Уголовно-правовая охрана финансово-хозяйственных отношений в сфере государственных закупок: компаративистский анализ законодательства Республики Беларусь, Российской Федерации и стран постсоветского пространства

Abstract

The article presents a comparative analysis of approaches to the regulation of financial and economic relations in the sphere of public procurement by the Belarusian and Russian legislation as well as the legislation of foreign countries, which in recent years have significantly adjusted the rules establishing responsibility for the use of public procurement for criminal activities, including through the “profile” criminalization of such violations. f particular interest in this regard are changes and additions to Russian legislation, as well as the legislation of the European post-Soviet States, in connection with the adoption of a new package of European directives (2014/23/EU, 2014/24/EU and 2014/25/EU) aimed at regulating public trading in the EU. Equally interesting is the comparative analysis of the new rules on criminal liability for violations of public procurement rules in the countries close to Russian and Belarusian specifics of legal protection of relations in public procurement (i.e. in Azerbaijan, Armenia, Georgia).
