Abstract

The subject of the article is one of the problems arising from the application of unifi ed solutions concerning the law of succession in cross-border relations, namely, the eff ectiveness of the rejection of inheritance on behalf of a minor residing abroad. The problem stems from the multiplicity of issues concerning the rejection of inheritance in legal transactions with foreign countries. The lack of comprehensive legal regulation, as well as case law or doctrine in this area cause a lack of legal certainty as to the outcome of a case. A hypothetical situation was created for the purpose of the article to indicate the complexity of the problem and to try to resolve it.
