| dc.description.abstract | Cel | Identyfikacja kluczowych instytucji amerykańskiego rynku pracy w latach 1933-1934. Zestawienie celów stawianych przed wprowadzanymi rozwiązaniami instytucjonalnymi z ostatecznie osiągniętymi rezultatami. Metoda badań | Wykorzystano przegląd literatury, analizę przepisów prawa i orzeczeń sądowych. Wnioski | Wbrew wcześniejszym doświadczeniom i bazujących na nich oczekiwaniom okres wielkiego kryzysu gospodarczego wiązał się przemodelowaniem rynku pracy w kierunku rozwiązań propracowniczych. Pierwszy okres rządów Franklina D. Roosevelta skutkował wprowadzeniem do amerykańskiego porządku prawnego niestosowanych dotąd rozwiązań, takich jak: płaca minimalna, prawo do rokowań zbiorowych, czterdziestogodzinny tydzień pracy oraz zakaz pracy osób poniżej 16. roku życia. Oryginalność / wartość / implikacje / rekomendacje | Masowy wzrost członkostwa w związkach zawodowych przesądził o utrzymaniu rozwiązań instytucjonalnych wymienionych w sekcji 7a Ustawy o Odbudowie Przemysłu (National Industrial Recovery Act) z czerwca 1933 r. pomimo uchylenia jej postanowień w orzeczeniu Sądu Najwyższego w sprawie Schechter Poultry Corp. v. United States. Uprawnienia zostały potwierdzone i rozszerzone w Ustawie o Krajowych Stosunkach Pracy (National Labor Relations Act) z lipca 1935 roku. | pl |
| dc.description.abstract | Purpose | Identification of key institutions in the American labour market in 1933–1934. Comparison of the objectives set for the institutional solutions introduced with the results ultimately achieved. Research method | A review of the literature, analysis of legal provisions and court rulings was applied. Results | Contrary to previous experiences and expectations based on them, the period of the Great Depression was associated with the remodelling of the labour market towards pro-employee solutions. The first term of F. D. Roosevelt’s administration resulted in the introduction of previously unused solutions into the American legal system, such as the minimum wage, the right to collective bargaining, the 40 hour working week and the prohibition of employment for persons under 16 years of age. Originality / value / implications / recommendations | The massive increase in labour union membership led to the retention of the institutional arrangements set out in Section 7a of the National Industrial Recovery Act of June 1933, despite the repeal of its provisions in the Supreme Court ruling in Schechter Poultry Corp. v. United States. These powers were confirmed and expanded in the National Labour Relations Act of July 1935. | pl |
