Abstract

Protection against discrimination based on gender identity and sexual orientation – some of the most intimate personal characteristics – has become part of the EU legal system relatively recently. The Court of Justice of the European Union plays an important role in shaping this protection. The aim of this article is to assess the level of actual protection against discrimination on the grounds of gender identity and sexual orientation through a comparative analysis of the anti-discrimination judgments of the CJEU concerning the rights of unions of transsexual and homosexual persons. The research shows that transsexual people and their relationships enjoy a greater degree and scope of protection against discrimination in their relationships than homosexual people do.
