Konstytucjonalizacja osobowości prawnej jako podstawa współpracy międzynarodowej gmin

Abstract

Municipalities (gminy) undoubtedly are legal personalities. This is well-established both in Polish law and relevant international regulations and results in a number of rights and freedoms. On the one hand, thus, municipalities may establish cooperation with their foreign counterparts, etc., whilst on the other hand, they are obliged to observe law. In practice, it means international activity (frontier, crossborder and interregional cooperation), as well as the obligation to act within the framework of Poland’s foreign policy (governmental administration control). The progression in practice can be noticed, which constitutes an interesting challenge for legal academics and commentators.
