Abstract

Przedmiotem rozprawy doktorskiej jest problematyka istoty interpretacyjnej roli Sądu Najwyższego USA. Zainteresowanie tą tematyką wynika z rosnącej debaty publicznej oraz wzrostu liczby komentarzy naukowych dotyczących działalności Sądu Najwyższego USA. Celem pracy jest ustalenie, na czym polega interpretacyjna rola tego organu w amerykańskim systemie prawnym i jaka jest jej istota. Praca weryfikuje hipotezę, że istotą interpretacyjnej roli Sądu Najwyższego jest jego zdolność do tak daleko idącej wykładni Konstytucji USA, iż modyfikuje jej treść materialną, wywierając wpływ na system prawny i społeczno-polityczny, bez zmiany dosłownej treści ustawy zasadniczej. Rozdział pierwszy omawia genezę, pozycję ustrojową i ustrój wewnętrzny Sądu Najwyższego. Rozdział drugi analizuje wybrane orzecznictwo z pierwszych lat funkcjonowania Sądu, gdy wykształciła się instytucja kontroli konstytucyjności prawa. Rozdział trzeci to analiza orzeczeń dotyczących prawa do aborcji oraz polityki akcji afirmatywnej.

The subject of this doctoral dissertation is the essence of the interpretive role of the U.S. Supreme Court. Interest in this topic stems from the growing public debate and the increasing number of scholarly commentaries regarding the activities of the Supreme Court. The main goal of the dissertation is to determine the nature of the Court’s interpretive role within the American legal system and to find its essence. The study tests the hypothesis that the core of the U.S. Supreme Court’s interpretive role lies in its ability to interpret the U.S. Constitution so extensively that it modifies its substantive content, influencing the legal and socio-political system without altering the literal text of the Constitution. The first chapter discusses the origins, constitutional position, and internal structure of the Supreme Court. The second chapter analyzes selected case law from the Court’s early years, during which the institution of judicial review was established in American law. The third chapter provides an analysis of rulings related to abortion rights and affirmative action policies.
