System wyborczy a układ sił politycznych w Sejmie (na przykładzie wyborów z 2007 i 2011 roku)

Abstract

W rozprawie przedstawiam prawno-polityczne zagadnienia systemu wyborczego i prawa wyborczego. Analizuję przepisy ordynacji wyborczej z 2001 r. i kodeksu wyborczego z 2011 r. Opisuję konstytucyjne zasady wyborów oraz wskazuję na zasadę wolnych i uczciwych wyborów. Wskazuję na istotne funkcje wyborów, gdyż wybory odgrywają kluczową rolę w życiu. Zgłaszanie kandydatów do Sejmu to istotny element procesu wyborczego. Wyborcy w wyborach dokonują wyboru personalnego wskazując kandydata na posła, dokonując tym samym wyboru politycznego. Przedstawiam wynik wyborów w 2007 r. i w 2011 r. oraz wskazuję jak kształtował się układ sił politycznych w Sejmie po przeprowadzonych wyborach. System wyborczy ma wpływ na wynik wyborów i tym samym na kształtowanie się system politycznego. Jednak to politycy w dużej mierze decydują o charakterze systemu wyborczego. Następuje wzajemne oddziaływanie systemu wyborczego i systemu politycznego.

In my doctoral thesis I present legal and political issues of the electoral system and electoral law. I analyze the regulations of the 2001 electoral system and the 2011 election code. I describe the constitutional principles of elections and refer to the principle of free and fair elections. I emphasize the essential functions of the elections, because the elections play the key role in life. Nomination of candidates to the Sejm is an important element of the electoral process. During the elections voters make their personal choice indicating a candidate for deputy, making in this way a political choice. I present the results of the 2007 and 2011 elections and I show how the balance of political forces in the Sejm was shaped after the elections. The electoral system influences the result of elections and thus it shapes the political system. However, it is the politicians who largely determine the nature of the electoral system. There is the interaction between the electoral and the political systems.
