Wokół znaczenia w języku prawnym - z punktu widzenia strukturalizmu

Abstract

The paper is devoted to the characterization of the legislative language conducted in the light of the most important notions of structuralism, which are the following: the notion of sign, meaning, contents plan and expression plan, problems of the connection of the language with the reality. The aim of the paper is to present the possibilities of the implementation of traditional structuralistic categories in research on the legislative language. The legislative language is characterized by the connection of the material scope of components of legislative texts with the system of valid law and its vision reflected in the actions undertaken by the legislator, as well as with a definite system of values and the cultural context as well as the processes of social communication. The importance of the structuralistic point of view to the research on the legislative language may be significant because of three planes. The legislative language exploits objects in the form of texts and it constitutes part of the cultural order as well as the sphere of social communication. Texts of the legislative language are characterized by being multilevel which consists in the legislative text's possession, apart from the descriptive dimension, the sphere of ethic and axiological references. One of the planes of its interpretation is the descriptive level, expressed in statements in the indicative or the imperative mood, the other is the normative layer constituting a base for constructing a particular kind of statements in the form of norms of proceedings.
