Wpływ intencji perswazyjnej nadawcy na styl dawnej i współczesnej wypowiedzi prawodawczej w języku polskim

Abstract

In the article the Author analyses the participation of persuasive acts in a legislative speech act: Old Polish and modern Polish by posing a question about the causes and results of a currently applicable legislative principle stipulating that the legislator should avoid providing a motive for the constituted law. The Author proves that Old Polish (up until as late as the 18th century) legał regulations included explicit and stylistically emphasised justifications of the formulated directives. Although deprived of explicit persuasive exponents (except preambles to some acts), a contemporary legislative speech act, is - in the Author's view - marked for implicit persuasiveness, both at the level of realisation of a general genre and stylistic pattern and in the layer of implicatures resulting from the choice of a specific way of linguistic expressing directive acts and functioning of texts of acts in the context of other legal acts. Intertextuality and functioning of law in social reception create a dialogic situation which is anticipated by the legislator by employing not only directive but also persuasive means of influencing addressees.
