Ochrona interesów finansowych Unii Europejskiej przez instytucje unijne i krajowe na przykładzie Polski

Abstract

Praca "Ochrona interesów finansowych Unii Europejskiej przez instytucje unijne i krajowe na przykładzie Polski" miała na celu ocenę skuteczności ochrony interesów finansowych oraz zaproponowanie zmian sprzyjających lepszej i bardziej efektywnej ochronie. Jako problem badawczy pracy postawiono pytanie, czy systemy ochrony interesów finansowych Unii funkcjonujące na szczeblu unijnym i krajowym skutecznie zapobiegają nadużyciom i nieprawidłowościom. W rozdziale pierwszym dokonana została analiza historycznego kształtowania się pojęcia interesów finansowych UE, zakres tego pojęcia w świetle obowiązujących aktów prawnych oraz na tle doktryny prawa finansów publicznych. W rozdziale drugim ocenione zostały uwarunkowania i praktyka ochrony realizowanej przez instytucje unijne, w tym przez Komisję Europejską, OLAF, Europejski Trybunał Obrachunkowy, Trybunał Sprawiedliwości UE, Prokuraturę Europejską oraz inne instytucje. Rozdział trzeci obejmował uwarunkowania i praktykę ochrony interesów finansowych realizowanej przez instytucje krajowe: NIK, Instytucje Zarządzające, KAS oraz inne instytucje. W pracy zostały pozytywnie zweryfikowane hipotezy robocze, zgodnie z którymi instytucje zaangażowane w ochronę interesów finansowych zarówno na szczeblu unijnym jak i krajowym posiadają wystarczające uprawnienia umożliwiające skuteczną ochronę, jednakże podejmowane przez nie działanie nie zapewniają optymalnego poziomu ochrony. W pracy zaproponowane zostały także rozwiązania, które mogłyby usprawnić ochronę interesów finansowych UE zarówno na poziomie unijnym jak i krajowym.

The dissertation "Protection of the European Union's financial interests by EU and national institutions on the example of Poland" was aimed at assessing the effectiveness of protection of financial interests and proposing changes conducive to better and more effective protection. The research problem of this dissertation is the question whether the systems of protection of the EU financial interests functioning at the EU and national level effectively prevent fraud and irregularities. The first chapter analyzes the historical evolution of the concept of EU financial interests, the scope of this concept pursuant to applicable legal acts and in the context of the doctrine of public finance law. The second chapter assesses the conditions and practice of protection implemented by EU institutions, including the European Commission, OLAF, the European Court of Auditors, the Court of Justice of the EU, the European Public Prosecutor's Office and other institutions. The third chapter covers the conditions and practice of protecting financial interests implemented by national institutions: the Supreme Audit Office, Managing Authorities, the National Tax Administration and other institutions. In this dissertation, the working hypotheses were positively verified, according to which institutions engaged in the protection of financial interests at both EU and national level have sufficient powers enabling effective protection, however, their actions do not provide the optimal level of protection. The work also proposed solutions which could improve the protection of EU financial interests at both EU and national level.
