Prawne aspekty polityki transportowej Unii Europejskiej

Abstract

Przedmiotem analizy podjętej w pracy jest polityka transportowa Unii Europejskiej, proces jej tworzenia, instytucjonalizacji oraz jej funkcjonowanie. Uchwycenie genezy oraz praktycznego stosowania tej polityki wydaje się o tyle istotne, iż jest to ogromna dziedzina zarówno, pod względem mnogości aktów prawnych, jak i finansowego zaangażowania Unii Europejskiej oraz krajów członkowskich. Analiza obejmuje objaśnienie podstawowych pojęć, przybliżenie historii kształtowania się polityki, prezentację realizujących ją instytucji oraz aktów prawnych i procedur ich podejmowania. W pracy znajdują się także rozważania dotyczące aktualnych problemów prawnych polityki transportowej Unii Europejskiej. Podjęto się próby weryfikacji tezy, że polityka transportowa Unii Europejskiej jest uregulowana w sposób niedoskonały, implikujący liczne problemy w sferze stosowania prawa, które powinny być usystematyzowane. Rozprawę oparto o strukturę siedmiu rozdziałów z których sześć dotyczy materii stricte europejskiej (w niezbędnym zakresie odnosząc się do poziomu międzynarodowego oraz do poziomu krajowego), natomiast siódmy został poświęcony funkcjonowaniu Polski w kontekście polityki transportowej Unii Europejskiej.

The main subject of the analysis in this work, is the politics of the transportation regulation of the European Union, the creation process, its institutionalization, as well as its functioning. The capture of the thesis statement is proved relevant to the number of regulations published in regards to these laws as well as the number of financing engaged by the EU and its members. The analysis incorporates the explanations of basic themes on the subject, as well as the history of the creation of the policies, and its current, and creation, implementation and execution structure. The work also portrays the current regulatory problems of the transportation policy of the EU. It attempts to verify the thesis that the politics of the European Union transportation are regulated imperfectly, implicating issues in executing the laws, and should be systemized. The dissertation is based on seven chapter, in which six are tied to European Union materials (necessarily tying back to international regulations, and that of the member states), while the seventh chapter assesses the functioning of the regulation of transportation of the European Union in regards to Poland.
