Posadowienie urządzeń przesyłowych na nieruchomości a status prawny jej właściciela

Abstract

Rozprawa ma odpowiedzieć na pytanie jak posadowienie urządzeń na nieruchomości wpływa na prawo własności. Jako tezę badawczą przyjęto stanowisko, że: posadowienie urządzeń przesyłowych nadmiernie ingeruje w przynależne właścicielowi prawo do nieruchomości. Rozprawa składa się z siedmiu rozdziałów, w których starano się udowodnić, że obciążenie nieruchomości przez wybudowanie na niej urządzeń przesyłowych, ustanowienie służebności przesyłu nadmiernie obciąża jej właściciela. Nadmierne obciążenie to znaczy takie, które wykracza ponad przepisy prawa. Wskazano tu, że właściciel nieruchomości nie posiada „realnego” uprawnienia do ochrony prawa własności. Starano się również określić czy właściciel nieruchomości może wpływać na to, gdzie urządzenia przesyłowe mają być wybudowane już na etapie planowania tych sieci oraz gdy urządzenia na nieruchomości już się znajdują. W pracy starano się spojrzeć na urządzenia przesyłowe w jak najszerszym zakresie. Nie ograniczono się tylko do służebności przesyłu, ale przedstawiono inne możliwości zgodnego z prawem posadowienia urządzeń na nieruchomości. Dodatkowo wskazano pewne elementy, które należy zmienić, żeby posadowienie urządzeń na nieruchomości odbywało się bez problemu oraz aby instytucja służebności przesyłu była bardziej przejrzysta.

The dissertation has been written to answer the question how the location of devices on a real estate influences the ownership. The thesis of the dissertation assumes that placing a transmission device excessively interferes in the ownership. The layout of the dissertation aims to prove the thesis. The dissertation consists of seven chapters in which the author attempted to prove that placing a transmission device and establishing the transmission easement are an overburden to the real estate owner. The overburden is defined as a burden that violates the law. The author indicated that the real estate owner does not have any “real” right to protect the ownership. The author tried to determine if the owner may have any influence on the location of the device during the preparation process of the project and when there are already some devices located on the real estate. The dissertation tries to look at a transmission device from a wider perspective. The author did not restrict herself to presenting the transmission easement but other possibilities of legal distribution of transmission devices on the property were described as well. Additionally, the elements that ought to be changed, so that the location of the device on the real estate does not cause difficulties and the transmission easement is more lucid, were presented in the dissertation.
