Prawnoustrojowa koncepcja i mechanizmy prawne implementacji prawa Unii Europejskiej do krajowego systemu prawnego Rzeczypospolitej Polskiej

Abstract

Przedmiotem rozprawy jest analiza procesu implementacji prawa Unii Europejskiej do krajowego systemu prawnego Rzeczypospolitej Polskiej. Celem pracy jest określenie etapów tego procesu oraz udziału organów władzy wykonawczej oraz władzy ustawodawczej w omawianym procesie. Analizie został również poddany udział organów władzy sądowniczej w procesie implementacji. Przedmiotem badań stały się ponadto wzajemne relacje pomiędzy organami władzy wykonawczej i organami władzy ustawodawczej. Następstwem prowadzonych prac badawczych jest zdefiniowanie procesu implementacji prawa Unii Europejskiej do krajowego systemu prawnego Rzeczypospolitej Polskiej oraz wyróżnienie procesu transpozycji, jako drugiego z etapów procesu implementacji. Efektem prowadzonej analizy jest również zdefiniowanie procesu implementacji jako szczególnego rodzaju (formy) procesu ustawodawczego. Pociągało to za sobą konieczność zbadania prawa Unii Europejskiej, które to podlega implementacji (wykonaniu) w krajowym systemie prawnym Rzeczypospolitej Polskiej

This dissertation examines the implementation process of the European Union law into the internal legal system of the Republic of Poland. The aim of this dissertation is presented the phases of the implementation process including the role of the executive, legislature and judiciary of this process, and at the same time, relationship between the institution of executive and legislature powers, as well. The first result of research is define the implementation process of the European Union law into the internal legal system of the Republic of Poland. The next result is distinguished the second phase of the implementation process – the transposition process. Conclusion of this research is defined the implementation process as a special form of legislative process. This is why it is necessary to analysis of the European Union law, which is implementing into the internal legal system of the Republic of Poland.
