Abstract

Przedmiotem dysertacji jest zagadnienie urlopu bezpłatnego udzielanego w celu pełnienia funkcji z wyboru. W rozprawie nastąpiła ocena regulacji tego zagadnienia. W pierwszym rozdziale przedstawiono rozważania dotyczące istoty i charakteru prawnego urlopu bezpłatnego udzielanego w celu pełnienia funkcji z wyboru. Omówione zostały ponadto podstawy aksjologiczne tej instytucji. Analizie poddano także inne zwolnienia od pracy udzielane w celu pełnienia funkcji z wyboru.W drugim rozdziale rozprawy doktorskiej nastąpiło omówienie ewolucji przepisów dotyczących urlopu bezpłatnego udzielanego w celu pełnienia funkcji z wyboru. Poznanie kontekstu historycznego obowiązujących rozwiązań prawnych było niezbędne celem oceny ich adekwatności względem bieżących warunków ustrojowych i ekonomicznych. Trzeci rozdział pracy doktorskiej został poświęcony zagadnieniu trybu udzielania urlopu bezpłatnego w celu pełnienia funkcji z wyboru, czasu jego trwania, a także obowiązków stron stosunku pracy związanych z zakończeniem przerwy od świadczenia pracy. W czwartym rozdziale analizie poddane zostały przepisy przewidujące uprawnienia związane z urlopem bezpłatnym udzielanym w celu pełnienia funkcji z wyboru. Podzielono je na uprawnienia o charakterze pracowniczym oraz uprawnienia o charakterze ustrojowym. W piątym rozdziale pracy doktorskiej poruszona została problematyka ochrony szczególnej związanej z korzystaniem z urlopu bezpłatnego w celu pełnienia funkcji z wyboru. Istotnym aspektem tej części była analiza zakresu ograniczeń nałożonych na pracodawcę.

The subject of the dissertation is the issue of unpaid leave granted for the purpose of performing elective functions. The dissertation evaluates the regulations on this matter. The first chapter presents considerations regarding the essence and legal nature of unpaid leave granted for the purpose of performing elective functions. The axiological foundations of this institution are also discussed. Other exemptions from work granted for the purpose of performing elective functions are also analyzed. In the second chapter of the doctoral dissertation, the evolution of regulations concerning unpaid leave granted for the purpose of performing elective functions is discussed. Understanding the historical context of existing legal solutions was necessary to assess their adequacy in relation to current constitutional and economic conditions. The third chapter of the doctoral thesis is devoted to the issue of the procedure for granting unpaid leave for the purpose of performing elective functions, its duration, and the obligations of the parties in the employment relationship related to the end of the break from work. The fourth chapter analyzes the provisions related to the entitlements associated with unpaid leave granted for the purpose of performing elective functions. These entitlements are divided into those of an employee nature and those of an organizational nature. The fifth chapter of the doctoral thesis addresses the issues of special protection related to taking unpaid leave for the purpose of performing elective functions. An essential aspect of this part was the analysis of the scope of restrictions imposed on the employer.
