Problematyka "własności literackiej" (prawa autorskiego) w okresie pozytywizmu i Młodej Polski

Abstract

The articIe touches upon fundamental problems of "literary property" (copyright) in the period of positivism and Young Poland. The author makes use of several types of source materials: books, compendia entries, literary works, journalistic works, letters, memoirs, official documents and (occasionaIly) films. RefIections and concIusions within this text are formulated on the grounds of observations reIated with various symptoms of literary life incIuding research on: periodical press, distinguished representatives of particular epochs, censorship and Aesop's language. Mazan aims at both presenting the codified results and ilIustrating literary and publishing circIes' reactions to these events, especiaIly in the case of the most resilient ones, mainly from Polish territories annexed by Russia. ConcIusions show that past omissions and former decisions paved the way to later specialist solutions and more profound compromises, because, thanks to modernists, they extended over the 20th century and have lasted until the present times.
