Referendum w kontrowersyjnych kwestiach moralnych w państwach europejskich

Abstract

Przedmiotowa rozprawa doktorska stanowi pogłębioną analizę prawnoporównawczą instytucji referendum w kontrowersyjnych kwestiach moralnych o charakterze światopoglądowym (aborcja, rozwód, małżeństwa osób tej samej płci). Badaniom poddano referendum ogólnokrajowe w ośmiu państwach członkowskich Unii Europejskiej, w których przeprowadzono głosowania w kontrowersyjnych kwestiach moralnych: Irlandia, Włochy, Malta, Chorwacja, Portugalia, Słowenia, Słowacja i Rumunia. Celem dysertacji doktorskiej jest omówienie konstytucyjnych i ustawowych podstaw referendum z podkreśleniem występujących podobieństw i różnic w analizowanych państwach, ze wskazaniem praktyki głosowania i problemów interpretacyjnych. W pracy przedstawiono i uporządkowano analizę orzecznictwa trybunałów krajowych i europejskich oraz omówiono rzeczywiste skutki konstytucyjno-prawne przeprowadzonych referendów. W pracy dokonano także oceny skuteczności regulacji prawnych poprzez ukazanie zależności pomiędzy treścią pytań referendalnych a ostatecznym kształtem normatywnym przyjętych rozwiązań.

The dissertation constitutes an in-depth comparative legal analysis of the institution of the referendum on controversial moral issues of a worldview nature (abortion, divorce, same-sex marriage). The study examines nationwide referendums in eight European Union member states which has been conducted on controversial moral issues in: Ireland, Italy, Malta, Croatia, Portugal, Slovenia, Slovakia and Romania. The purpose of the dissertation is to discuss the constitutional and statutory bases of the referendum, discover the similarities and differences that exist in the analyzed countries and to indicate voting practices and interpretive problems. The paper presents and organizes an analysis of the jurisprudence of national and European tribunals and discusses the actual constitutional-legal effects of the referendums. The paper also evaluates the effectiveness of the regulations by showing the relationship between the content of the referendum questions and the final normative shape of the adopted solutions.
