Przestępstwo bezprawnego pozbawienia wolności w ujęciu karnoprawnym i kryminologicznym

Abstract

Rozprawa doktorska została poświęcona problematyce przestępstwa bezprawnego pozbawienia wolności. Składa się ona z ośmiu rozdziałów, które poprzedza wprowadzenie, a kończy podsumowanie. W rozdziale I omówiono metodykę badań. Wskazano przedmiot i cel badań, określono problemy i hipotezy badawcze, przedstawiono zastosowane metody, techniki i narzędzia badawcze oraz organizację i przebieg badań. Rozdział II poświęcono przedstawieniu historycznej ewolucji regulacji badanego przestępstwa. W rozdziale III przedstawiono ewolucję uregulowań art. 189 w kodeksie karnym z 1997 r.W rozdziale IV dokonano analizy ustawowych znamion badanego przestępstwa.Rozdziały V-VIII mają charakter empiryczny. W rozdziale V przedstawiono statystyczny obraz przestępstwa (policyjne dane statystyczne).W rozdziale VI zaprezentowano dane osobopoznawcze sprawców przestępstwaz art. 189 kk oraz osób pokrzywdzonych,uzyskane na podstawie wyników badań aktowych. Wskazano też najczęstsze przejawy, sposoby, motywy sprawców. W rozdziale VII zaprezentowano różne sposoby reakcji karnej, zastosowanej wobec sprawców przestępstwa z art. 189 kk w świetle wyników badań akt spraw karnych.W rozdziale VIII problematykę tę przedstawiono w świetle danych statystycznych Ministerstwa Sprawiedliwości. Rozprawę doktorską kończą wnioski z przeprowadzonych badań empirycznych, służące kompleksowemu poznaniu fenomenu przestępstwa bezprawnego pozbawienia wolności, zarówno w aspekcie prawno-karnym, jak i kryminologicznym.

The doctoral dissertation was devoted to the problem of the crime of unlawful deprivation of liberty. It consists of eight chapters, preceded by an introduction and concluded by a conclusion. Chapter I discusses the research methodology. In this chapter were presented subject and purpose of the research were indicated, research problems and hypotheses were defined, the methods, techniques and research to ols used, as well as the organization and course of research. Chapter II is devoted to the presentation of the historical evolution of the regulation of the analyzed crime. Chapter III presents the evolution of the provisions of Art. 189 in the Penal Code of 1997. Chapter IV analyzes the statutory features of the crime being the subject of the research. Chapters V-VIII are empirical. Chapter V presents the statistical picture of crime (police statistical data). Chapter VI presents the personal identification data of the perpetrators of the crime under Art. 189 of the Penal Code and of injured persons obtained on the basis of the results of file research In this chapter were also indicated the most common man if estations, methods and motives of the perpetrators. Chapter VII presents various methods of penal reaction applied to the perpetrators of the crime under Art. 189 of the Penal Code in the light of the results of the examination of criminal case files. On the other hand, in Chapter VIII, these issues are presented in the light of the statistical data of the Ministry of Justice. The doctor al dissertation ends with conclusions from the conducted empirical research, serving a comprehensive understanding of the phenomenon of the crime of unlawful imprisonment, both in the legal and criminal and criminological aspects.
