Pozycja ustrojowa i zakres kompetencji Prezydenta Federacji Rosyjskiej

Abstract

Przedmiotem rozprawy doktorskiej jest określenie pozycji ustrojowej oraz ukazanie zakresu kompetencji Prezydenta Federacji Rosyjskiej. Celem głównym rozprawy jest weryfikacja postawionej hipotezy głównej, stanowiącej o tym, że Prezydent Federacji Rosyjskiej posiada bardzo szeroki wachlarz kompetencji względem władzy ustawodawczej, wykonawczej i sądowniczej, a uprawnienia te stanowią o dominacji Prezydenta Federacji Rosyjskiej nad poszczególnymi władzami. Zgodnie z tym założeniem konieczne było w treści rozprawy jak najszersze ujęcie wzajemnych relacji zachodzących pomiędzy prezydentem a poszczególnymi władzami Federacji Rosyjskiej. Powyższe kwestie poddane zostały analizie także w oparciu o weryfikację przyjętych tez i problemów szczegółowych. Określone zostały więc też zagadnienia dotyczące procedury wyborów głowy państwa i jej kadencji. Główną metodą badawczą w zakresie przeprowadzonych badań jest metoda dogmatyczna. Analiza poszczególnych aktów normatywnych, jak i literatury polskiej oraz obcojęzycznej, a także stanowisk przedstawicieli doktryny prawa polskiego i prawa rosyjskiego, orzecznictwa Sądu Konstytucyjnego oraz stosowanej praktyki ustrojowej pozwoliły na weryfikację tezy głównej, tym samym w sposób kompleksowy rozstrzygnięto kwestie zakresu prezydenckich uprawnień w relacjach z legislatywą, egzekutywą i władzą sądowniczą. Ponadto, poczyniona analiza pozwoliła na wskazanie pozostałych kompetencji głowy państwa, które determinują pogląd o szczególnej pozycji prezydenta. Dzięki określeniu faktycznego systemu rządów istniejącego w Federacji Rosyjskiej określono także pozycję ustrojową głowy państwa. Poczynione analizy zostały jednocześnie uzupełnione o inną metodę badawczą, a mianowicie historyczno-porównawczą. W rozprawie przybliżono także kwestie dotyczące zmiany ustawy zasadniczej z 2020 roku, co pozwoliło uwzględnić w jej treści w pełni aktualne rozwiązania prawnoustrojowe. Poza elementami stricte formalnymi, w rozprawie doktorskiej uwzględnione zostały także uwarunkowania pozakonstytucyjne mające bez wątpienia istotny wpływ na rolę polityczno-ustrojową Prezydenta Federacji Rosyjskiej.

The subject of the doctoral dissertation is to define the political position and show the scope of competence of the President of the Russian Federation. The main purpose of dissertation is to verify the main hypothesis that the President of the Russian Federation has a very wide range of powers in relation to the legislative, executive and judiciary, and these powers determine the dominance of the President of the Russian Federation over individual authorities. In accordance with this assumption, it was necessary in the content of the dissertation to present the mutual relations between the President and the various authorities of the Russian Federation as broadly as possible. The above issues were also analyzed based on the verification of the adopted theses and detailed problems. Therefore, issues related to the procedure for the election of the head of state and his term of office were also defined. The main research method in the field of research conducted is the dogmatic method. The analysis of individual normative acts, as well as Polish and foreign literature, as well as the positions of representatives of the doctrine of Polish and Russian law, the jurisprudence of the Constitutional Court and the applied systemic practice allowed for the verification of the main thesis, thus the issues of the scope of presidential powers in relations with the legislature were comprehensively resolved, executive and judiciary. In addition, the analysis made it possible to indicate the remaining powers of the head of state, which determine the view of the special position of the president. By determining the actual system of government existing in the Russian Federation, the political position of the head of state was also defined. At the same time, the analyzes were supplemented with another research method, namely the historical-comparative one. The dissertation also outlined the issues related to the amendment to the Basic Law of 2020, which made it possible to include fully current legal and constitutional solutions in its content. In addition to strictly formal elements, in doctoral dissertation also includes non-constitutional conditions that undoubtedly have a significant impact on the political and systemic role of the President of the Russian Federation.
