Przestępstwo posługiwania się cudzym dokumentem tożsamości - ujęcie prawne i kryminologiczne

Abstract

Rozprawa doktorska została poświęcona problematyce przestępstwa posługiwania się cudzym dokumentem tożsamości. Składa się ona z jedenastu rozdziałów, które poprzedza wprowadzenie, a kończy podsumowanie. W rozdziale I omówiono metodykę badań. Wskazano przedmiot i cel badań, określono problemy i hipotezy badawcze, przedstawiono zastosowane metody, techniki i narzędzia badawcze oraz organizację i przebieg badań. Rozdział II poświęcono problematyce pojęcia „dokumentu” w rozumieniu interdyscyplinarnym oraz dokonano przeglądu poszczególnych kategorii dokumentów publicznych, do których należą dokumenty tożsamości. W rozdziale III dokonano charakterystyki dokumentów tożsamości występujących w obrocie prawnym, natomiast w IV rozdziale analizy pojęcia dokumentu stwierdzającego prawa majątkowe. Kolejny rozdział rozprawy został poświęcony aspektom historycznym badanego przestępstwa. Omówiono w nim procesy kształtowania się oraz przemiany badanego przepisu karnego. W rozdziale VI skupiono się nad problematyką przestępstwa posługiwania się cudzym dokumentem stypizowanego w art. 275 § 1 i § 2 k.k. w świetle obowiązującego prawa. Cztery kolejne rozdziały mają charakter empiryczny. W rozdziale VII przedstawiono statystyczny obraz przestępstwa posługiwania się cudzym dokumentem tożsamości, w rozdziale VIII zaprezentowano dane osobopoznawcze sprawców przestępstw określonych w art. 275 k.k., uzyskane na podstawie wyników badań aktowych. Wskazano również najczęstsze przejawy, sposoby i motywy działania sprawców przestępstw. Rozdział IX poświęcono ofierze badanego przestępstwa. Pokazano relację pomiędzy sprawcą a ofiarą przestępstwa oraz wskazano rolę ofiary w genezie przestępstwa posługiwania się cudzym dokumentem tożsamości. W rozdziale X zaprezentowano różne sposoby reakcji karnej zastosowanej wobec sprawców przestępstw z art. 275 k.k. w świetle wyników badań akt spraw karnych oraz w świetle danych statystycznych Ministerstwa Sprawiedliwości. Rozdział XI porusza problematykę przeciwdziałania przestępstwu posługiwania się cudzym dokumentem tożsamości. Rozprawę doktorską kończą wnioski z przeprowadzonych badań empirycznych, służące kompleksowemu poznaniu fenomenu przestępstwa posługiwania się cudzym dokumentem tożsamości zarówno w aspekcie prawno-karnym, jak i kryminologicznym.

The dissertation was dedicated to the problem of the crime of using someone else's identity document. It consists of eleven chapters, which are preceded by an introduction and concluded by a summary. Chapter I discusses the methodology of research. The subject and aim of research has been indicated, research problems and hypothesis have been defined, applied methods, techniques and research tools as well as the organisation and course of research have been presented. Chapter II deals with the concept of 'document' in an interdisciplinary terms and reviews the different categories of public documents to which identity documents belong. Chapter III characterises identity documents occurring in legal transactions, while Chapter IV analyses the concept of a document stating property rights. The next chapter of the dissertation was dedicated to historical aspects of the given crime. It discusses the processes of formation and transformation of the penal provision. Chapter VI focuses on the issue of the offence of using another person's document which is defined in Article 275 § 1 and § 2 of the Polish Penal Code in the light of the current law. The next four chapters are of empirical attitude. Chapter VII represents a statistical picture of the crime of using another person's identity document, Chapter VIII represents personal-recognition data of violators of crimes defined in Article 275 of the Polish Penal Code, obtained on the base on the results of file research. The most frequent manifestations, methods and motives of the violators are also included. Chapter IX is dedicated to the victim of the given crime. It shows the relation between the perpetrator and the victim of the crime and indicates the role of the victim in the genesis of the crime of using another person's identity document. Chapter X represents various ways of penal reaction applied to perpetrators of offences under Article 275 of the Criminal Code in the light of the results of researches of criminal case files and in the light of statistical data of the Ministry of Justice. Chapter XI deals with the problem of counteracting the crime of using someone else's identity document. The dissertation ends with conclusions from the conducted empirical research, serving as a comprehensive study of the phenomenon of the crime of using someone else's identity document, both from the legal, penal and criminological aspect.
