Postępowanie ze skazanymi uzależnionymi od alkoholu w izolacji penitencjarnej

Abstract

Przedmiotem badań uczyniono postępowanie ze skazanymi uzależnionymi od alkoholu w izolacji penitencjarnej. Głównym celem pracy jest analiza funkcjonowania i wykonywania kary pozbawienia wolności w systemie terapeutycznym wobec skazanych uzależnionych od alkoholu. Badaniom poddano instytucje wykonywania kary pozbawienia wolności w systemie terapeutycznym. Oprócz Kodeksu karnego wykonawczego, przeanalizowano szereg aktów prawnych o charakterze ustawowym, jak i wykonawczym oraz dokonano przeglądudorobku naukowego w zakresie wyznaczonym celem badań. Przybliżono standardy międzynarodowe gwarantujące przestrzeganie wspólnychzasad polityki penitencjarnej oraz dokonano analizy opracowań podejmujących kwestie kształtowania się idei zindywidualizowanego traktowania skazanych i wykonywania kary pozbawienia wolności zgodnie z podstawową zasadą humanitaryzmu wykonywania kary. Wykorzystano dwie uzupełaniające się metody badawcze. Jedna z nich to analiza danych statystycznych, pogłębiona o badania empiryczne za pomocą metody sondażu diagnostycznego i techniki ankietowania. Praca ma charakter monograficzny. Przeprowadzona w oparciu o model badania triangulacyjnego analiza dotycząca różnych aspektów funkcjonowania systemu terapeutycznego wykonywania kary pozbawienia wolności wobec skazanych uzależnionych od alkoholu pozwoliła określić m.in. skuteczność oddziaływań terapeutycznych stosowanych wobec skazanych uzależnionych od alkoholu i sformułować postulaty, które są szczególnie istotne dla praktyki postępowania ze skazanymi uzależnionymi od alkoholu odbywającymi karę w systemie terapeutycznym.

The subject of the research was the treatment of convicts addicted to alcohol in penitentiary isolation. The main goal of the study is to analyze the functioning and execution of imprisonment in the therapeutic system for convicts addicted to alcohol. Institutions of imprisonment in the therapeutic system were examined. In addition to the Executive Penal Code, a number of legal acts as well as executive acts were analyzed and the scientific achievements were reviewed in the scope determined by the research objective. The international standards guaranteeing the observance of common principles of penitentiary policy were presented, and the analyzes of studies dealing with the development of the idea of individualized treatment of convicts and the execution of imprisonment in accordance with the basic principle of humanitarianism in the execution of punishment were made. Two complementary research methods were used. One of them is the analysis of statistical data, the second is empirical research using the diagnostic survey method and the survey technique. The work is monographic. The analysis carried out on the basis of a triangulation study model on various aspects of the functioning of the therapeutic system for the execution of imprisonment against alcohol-dependent convicts allowed to determine, inter alia, the effectiveness of therapeutic interactions applied to alcohol-dependent convicts and formulate postulates that are particularly important for the practice of proceedings with alcohol-dependent convicts serving their imprisonment in the therapeutic system.
