Instrumenty wsparcia dla rozwoju odnawialnych źródeł energii

Abstract

Polityka klimatyczno-energetyczna Unii Europejskiej zakłada wzrost udziału energii ze źródeł odnawialnych w końcowym zużyciu energii brutto na drodze realizacji postanowień Dyrektywy 2009/28/WE i Dyrektywy 2018/2001. Ze względu na niski udział odnawialnych źródeł energii w końcowym zużyciu energii brutto w Polsce poszukuje się rozwiązań dynamizujących wzrost tego elementu realizacji polityki klimatyczno-energetycznej w świetle zobowiązań europejskich i ogólnoświatowych. Celem badawczym rozprawy doktorskiej jest analiza prawnych instrumentów wsparcia odnawialnych źródeł energii ze szczególnym uwzględnieniem instrumentów podatkowych. W pracy sformułowano również szereg celów szczegółowych oraz pytań badawczych. Autor stawia główną hipotezę badawczą, że instrumenty podatkowe w połączeniu z innymi instrumentami wsparcia przyczyniają się do rozwoju odnawialnych źródeł energii. Formułuje również 5 hipotez szczegółowych, weryfikowanych w poszczególnych rozdziałach pracy. W rozprawie doktorskiej wykorzystano kilka metod badawczych, w tym głównie metodę dogmatyczno-prawną, prawno-porównawczą oraz we wnioskowaniu metodę dedukcyjną. Zawartość merytoryczną pracy doktorskiej ujęto w 5 rozdziałach wraz z wprowadzeniem i wnioskami. Przeprowadzone analizy i badania umożliwiły osiągnięcie postawionych celów pracy i pozytywną weryfikację hipotez badawczych. Praca doktorska formułuje szereg wniosków w zakresie zastosowania instrumentów wsparcia odnawialnych źródeł energii w Polsce, uwzględniając instrumenty podatkowe dla wzrostu udziału odnawialnych źródeł energii.

The climate and energy policy of the European Union assumes an increase in the share of energy from renewable sources in the gross final energy consumption by implementing the provisions of Directive 2009/28/EC and Directive 2018/2001. Due to the low share of renewable energy sources in gross final energy consumption in Poland, solutions are sought to dynamize the growth of this element of the implementation of the climate and energy policy in the light of European and global obligations. The research objective of the doctoral dissertation is to analyze the legal instruments for supporting renewable energy sources, with particular emphasis on tax instruments. The thesis also formulates a number of specific objectives and research questions. The author puts forward the main research hypothesis that tax instruments in combination with other support instruments contribute to the development of renewable energy sources. He also formulates 5 detailed hypotheses, verified in individual chapters of the work. Several research methods were used, including mainly the dogmatic-legal, legal-comparative methods, and the deductive method in inference. The content of the doctoral dissertation is presented in 5 chapters along with the introduction and conclusions. The conducted analyzes and research made it possible to achieve the set aims of the work and to positively verify the research hypotheses. The doctoral dissertation formulates a number of conclusions in the field of the use of instruments to support renewable energy sources in Poland, taking into account tax instruments for the increase of the share of renewable energy sources.
