Rejestracja testamentów i jej wpływ na bezpieczeństwo obrotu prawnego (de lege lata i de lege ferenda)

Abstract

Decydując się na sporządzenie testamentu, niezwykle istotne z punktu widzenia bezpieczeństwa obrotu prawnego, jest to, aby był on zgodny z obowiązującymi przepisami oraz został ujawniony po śmierci spadkodawcy. Aby zapobiec nieujawnieniu testamentu Krajowa Rada Notarialna w 2011 roku utworzyła Notarialny Rejestr Testamentów (NORT), który umożliwia rejestrację niektórych form testamentów, a tym samym, ich odnalezienie po śmierci spadkodawcy. Celem niniejszej dysertacji jest analiza procesu rejestracji testamentów w Polsce i w Europie oraz zbadanie jej wpływu na bezpieczeństwo obrotu prawnego. Praca składa się ze wstępu, pięciu rozdziałów oraz podsumowania i wniosków końcowych. Rozdział I. przedstawia jedną z kluczowych zasad prawa – zasadę bezpieczeństwa obrotu prawnego wraz z wybranymi instrumentami jej gwarancji. Rozdział II. zawiera analizę wszystkich form testamentów przewidzianych w KC (w kontekście bezpieczeństwa obrotu prawnego oraz ewentualnej rejestracji w NORT) oraz wskazuje konsekwencje ujawnienia testamentu po stwierdzeniu praw do spadku. W rozdziale III. została omówiona Europejska Sieć Rejestrów Testamentów, utworzona przez Stowarzyszenie ARERT, której częścią jest m.in. NORT. Rozdział IV. Zawiera szczegółową analizę NORT – od wskazania podstaw prawnych jego funkcjonowania do przebiegu rejestracji i wyszukiwania testamentów w Polsce. Rozdział V. przedstawia analizę badań ankietowych, które dotyczyły kwestii sporządzenia i rejestracji testamentu.

When deciding to create a will, it is extremely important in the view of legal transactions security that it comply with the applicable regulations and that it is disclosed after the testator's decease. In order to prevent the will from being disclosed, the National Council of Notaries established in 2011 the Notary Register of Wills (NORT), which enables the registration of certain forms of wills, and thus their finding after the testator's death. The purpose of this dissertation is to analyze the registration process of wills in Poland and Europe and has no impact on safety. The purpose of this dissertation is to analyze the process of will registration in Poland and Europe, examine its impact on the security of legal transactions. The dissertation consists of an introduction, five chapters, as well as a summary and final conclusions. Chapter I. presents one of the key law principles – the principle of legal security transactions together with selected instruments of its guarantee. Chapter II. contains an analysis all will forms provided by the Polish Civil Code (in the context of the legal transactions security and possible registration in NORT) and indicates the consequences of disclosing a will after establishing the right to inheritance. Chapter III. concerns the European Network of Registers of Wills, created by the ARERT including, among others, Polish NORT registry. Chapter IV. focuses on analysis of the NORT - from indication of the legal basis for its functioning, to registration and searching for wills in Poland. Chapter V. presents an analysis of surveys that concerned the issue of drawing up and registering a will.
