Frontex jako agencja wyspecjalizowana Unii Europejskiej

Abstract

Problematyka zarządzania zewnętrznymi granicami Unii Europejskiej jest niezwykle istotna z punktu widzenia jej dalszego funkcjonowania, w tym bezpieczeństwa całej UE i poszczególnych państw członkowskich. Tylko w 2014 r. granice UE przekroczyło ponad 270 tys. nielegalnych migrantów z państw trzecich, a w 2015 r już blisko 1,8 mln. Tak duża liczba nielegalnych migrantów, którzy mimo istnienia zintegrowanej polityki zarządzania granicami zewnętrznymi UE, a także działalności samego Frontexu przedostali się na teren UE, implikuje pytania o ich efektywność, a także o obecną oraz przyszłą działalność Europejskiej Agencji Straży Granicznej i Przybrzeżnej. Problematyka ta, mimo swojej wagi, nie doczekała się w polskiej, ani w zagranicznej literaturze przedmiotu kompleksowego opracowania w zakresie funkcjonowania oraz działalności Frontexu. Biorąc pod uwagę znaczenie podjętego tematu, zasadniczym celem rozprawy jest uporządkowanie oraz kompleksowe przedstawienie i analiza uregulowań dotyczących Frontexu jako agencji wyspecjalizowanej UE. Praca zmierza do udzielenia odpowiedzi na podstawowe pytanie badawcze, dotyczące kierunków i zakresu zmian w strukturze i działalności Europejskiej Agencji Zarządzania Współpracą Operacyjną na Zewnętrznych Granicach Państw Członkowskich Unii Europejskiej, a następnie Europejskiej Agencji Straży Granicznej i Przybrzeżnej.

The issue of managing the European Union's external borders is extremely important from the point of view of its further functioning, including the security of the entire EU and individual Member States. Only in 2014, the borders of the EU exceeded 270,000 illegal migrants from third countries, and in 2015 almost 1.8 million. Such a large number of illegal migrants who, despite the existence of an integrated EU external border management policy, as well as the activities of Frontex itself, have entered the territory of the EU, raises questions about their effectiveness, as well as about the current and future activities of the European Border and Coast Guard Agency. Despite its importance, this issue has not been comprehensively elaborated on in the field of the functioning and activities of Frontex in the Polish and foreign literature on the subject. Taking into account the importance of the topic under consideration, the main aim of the dissertation is to organize, comprehensively present and analyze the regulations concerning Frontex as a specialized EU agency. The work aims to answer the basic research question regarding the directions and scope of changes in the structure and activities of the European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union, and then the European Border and Coast Guard Agency.
