Ретроспективный анализ института давности привлечения к уголовной ответственности

Abstract

Goal – study of the legal and social origins of the institution of the statute of limitations for criminal prosecution in foreign and domestic criminal law. Research methodology – on the basis of a retrospective analysis, the moment of introducing the statute of limitations to criminal liability was established in the legislation, an attempt was made to identify the social and legal grounds for its introduction. Score/results – the reason for the study is the lack of theoretical research in the field of historical analysis of the causes and conditions of the institution of the statute of limitations for criminal liability. Originality/value – in the science of criminal law of the Republic of Belarus, there are no theoretical studies regarding the statute of limitations for criminal liability, the regulation of the application of this legal institution is not well developed. No earlier attempts have been made to retrospectively analyze this legal institution.
