Abstract

This article concerns the institution of changes of the agreement regulated by Article 298-301 of bankruptcy and restructing law. The author makes a critical analysis of solutions de lege lata taking as a reference the principle of fairness and seeks to show that the restrictive conditions for the changes of the agreement under Article 298, are inadequate to the needs of the protection of creditors and thus the safety of trading.
