Przestępczość związana z nielegalną imigracją w kontekście przemian zjawiska i prawa

Abstract

В работе К. Лясковской рассматриваются отдельные проблемы преступности, связанной с незаконной иммиграцией иностранцев в Польшу. Отмечаются изменения, произошедшие в этом явлении и относящемся к нему правовом регулировании на протяжении последних лет. Подчеркивается криминогенный характер иммиграции в Польшу и рассматривается реакция на нее польского права. Из статьи вытекает, что для иностранцев Польша является прежде всего транзитной страной на пути в другие страны Евросоюза, хотя во многих случаях она становится и местом назначения, особенно для жителей Азии. Установлено, что на ее территории иммигранты совершают преступления, представляющие угрозу для государственных интересов. К ним относится прежде всего незаконное пересечение границы, подделка документов, деятельность в организованных преступных группах. В отношении указанного преступного поведения польское государство предпринимало ряд правовых мер, направленных на криминализацию в первую очередь деяний, связанных с незаконным пересечением границы, а затем и с незаконным пребыванием иностранцев на территории Польши. Эти меры, к сожалению, часто оказывались запоздалыми на фоне масштабов развития и механизмов незаконной иммиграции, являющейся причиной совершаемых преступлений.

The study is concerned with a discussion of selected problems of crime related to the illegal immigration of foreigners into Poland. It describes the evolution of the phenomenon and the law related to it over recent years. In addition, it illustrates the criminogenic nature of immigration to our country and the reaction of the Polish law to behaviour connected with it. The article shows that Poland is mainly a country of transit for foreigners heading towards other countries of the European Union, but it is also becoming the destination, especially for people from Asia. It was found that immigrants commit crimes affecting various interests of the Polish State, first of all, illegal crossing of the border, falsification of documents, and unlawful actions connected with organized crime structures. In the face of the behaviour mentioned above, the Polish state has taken legal steps designed, primarily, to criminalize the activities associated with illegal crossing of the border, and then with the illegal stays of foreigners in our country. These activities have, unfortunately, sometimes been a little too late in relation to the development of the scale and the mechanisms of illegal immigration and crimes related to it.
