Abstrakt: The main tasks of the Agricultural Property Agency have been changed during&#xD;
the last eighteen years. These tasks are defined in art. 6 of the act on management&#xD;
of agricultural property of the State Treasury. The most important changes in&#xD;
this respect were made in 2003 as a result of regulations introduced by the act on&#xD;
formation of agrarian system. In particular the Agricultural Property Agency is obliged&#xD;
to carrying out of the privatization and restructuring of the agricultural properties&#xD;
owned by the State as well as to support improvement of family farms structure.&#xD;
The Agricultural Property Agency, carrying out its tasks, sales and leases the&#xD;
state property by using the tender procedures. To improve family farms structure,&#xD;
the Agency was granted with a statutory pre–emption right as well as with a right of&#xD;
acquisition of agricultural property. However, the final results of its activity are not&#xD;
satisfactory, as in the Agricultural Resources of the State Treasury still remains 2,6&#xD;
million hectares of land.</description>

Abstrakt: The issue of diversification of farms (agricultural holdings) is very complicated in the Polish legal system. The basic problem in this area is the lack of statutory definition in the state regulations. Due to the lack of this definition it is not possible do define clearly the purposes and directions of diversification. The indicated lack of statutory definition of diversification of agricultural holdings requires the search for the scope of this notion not only in a juridical approach but also in an economic one. On the whole, from the point of view of economic sciences diversification of farms means diversification in the structure of agricultural production as well as exploiting ground resources, capital and labour in farms for activities other than agricultural activity. It should also be added that the scale of production and incomes received from agricultural activity are determined by the condition of land resources in Polish farms, and above all, by fragmented land structure. Therefore there is no doubt that the Polish legislator should search for legal criteria for diversification which would also include the above mentioned economic parameters. The final purpose of such diversification should be the capacity to absorb the union support. In the Polish economic reality, necessity of supporting low output farms remains the main problem. This support should be based not only on the state funding but also union funding. This is a key issue for gradual change in land structure of farms. It seems essential to undertake complex activities aiming at the creation of full programme of changes in agriculture. ‘Rural’ policy of particular union states accepting legal instruments of diversification as a starting point should lead to lasting and balanced development of rural areas.</description>

Abstrakt: The article contains an analysis of premises of acquiring uniform direct payments,&#xD;
with special emphasis on the regulations concerning the demand for possessing&#xD;
agricultural lands (covered by the motion for the admission of payment). The&#xD;
aim of the authors’ deliberations is to determine what meanings the notion „possession”&#xD;
is used in the regulations. The legislator of these regulations does not define&#xD;
the term „possession”, referring instead to the definition contained in the civil code.&#xD;
Yet, to satisfy the demand for possessing agricultural lands, additional premises are&#xD;
to be fulfilled. Legal regulations concerning payments introduce a kind of a qualified&#xD;
possession consisting in actual agricultural usage of lands. The article points to&#xD;
some terminological problems on the private–public law border, reflected in judicial&#xD;
decisions. Legal character of payments indicates that direct payments belong to&#xD;
a public–legal sphere, whereas the legislator uses private law notions to define premises&#xD;
of acquiring the right to them.</description>
