Tytuł: Prokuratorski nadzór ogólny w Polsce Ludowej na tle idei sądownictwa administracyjnego
Autorzy: Łysko, Marcin
Abstrakt: General supervision by the public prosecutor's office (so called nadzór ogólny) in Poland was introduced in 1950, together with the reform of this office based on Soviet patterns. The essence of the institution of general supervision was to control legal action of administration and to control citizens' behavior from the legal perspective. This institution replaced administrative courts, because Communist authorities did not agree to reestablish administrative courts after World War II. Accordingto them, the general supervision was much better than the administrative courts, because legal control was based not only on the protection of individual interest, but also interest of State. In the middle 50's duringthe period of libefalization of social and political life, Polish lawyers presented view that general supervision is not able to replace administrative courts. The main reason was that the prosecutor could only sue illegal acts of the administration. Contrary, the basie role of administrative courts was to abrogate and change administrative decisions. In 1958 lawyers proposed a bill reestablishing administrative courts, but it was rejected by the Communist authorities. This situation was changed in 1980, when the Supreme Administrative Court (NSA) was established.

Abstrakt: The decree issued on September 25ᵗʰ, 1945 called The Marital law, was a legal act, which unified matrimonial law in Poland after World War II. One of the most characteristic features of this law was the institution of divorce, because it was implemented to the Polish legal system for the first time as a common institution to all citizens, regardless previous religious regulations. The origins of legal regulation come from the bill prepared by Codification Commission (Komisja Kodyfikacyjna) in 1929. This bill was constructed by Karol Lutostański, one of the most outstanding Polish lawyers. You can also find some traces coming from German, French and Austrian laws, which existed in Poland before World War II. The most important factor, which had influence on the shape of new law, were however views of its authors, which were based on the theory of socialization of private law. The decree followed the rule of durability of marriage, which had influence on shape of the divorce law. The divorce could be stated by court only when permanent breakdown of marriage was proved. You also had to give the reasons of this breakdown, to point who wasguilty of it. However, you couldn'tgetdivorce if the interestof minor children was against it. Subsequent jurisdiction formulated new restrictions, which resulted with the difficulty of getting divorce.

After World War II this topie (e.g. Soviet law) was not analyzed. There are only few publications on this topie, but they are written by historians, not by historians of law. Some publications referto Soviet problem from the point of view of legal doctrines. That is why future research on this topie is worth undertaking.
