Abstrakt: Group of agricultural producers in the EU legislation is the preferred form of running an agricultural activity. The European Union in order to encourage individual farmers to cooperate within a group of agricultural producers introduced a number of incentive instruments, including a system of direct financial assistance to the group. Financial support from the European Union financial resources groups of agricultural producers receive from May 01st, 2004. Currently, the procedure and conditions for financial assistance granted to groups under the Common Agricultural Policy for the years 2014-2020 were largely modified. The above mentioned changes become effective from August 19th, 2016 and are strictly connected with the entry into force of the Regulation of the Minister of Agriculture and Rural Development dated August 02nd, 2016 On Detailed Conditions and Procedure for Granting Payment and Reimbursement of Financial Aid under the Action: „Setting up Producer Groups and Producer Organizations”. Under the new rules, financial assistance from the European Union may only receive a group of agricultural producers consisting solely of individuals. The legislator therefore limits the number of potential beneficiaries of aid excluding legal persons and organizational units without legal personality and with legal capacity. Moreover, financial aid would not be granted to a group of agricultural producers which had already received financial assistance from the EU budget funds. In addition, the legislator in the new Regulation introduced a number of criteria on which basis depends the order of granting financial aid. The analysis of the above criteria leads to the conclusion that the financial assistance is directed to the agricultural producer groups operating in the form of a cooperative, including at least 10 members, at the area with high agrarian fragmentation.</summary>

Abstrakt: Ownership is the main property right which gives the fullest control over a thing and, simultaneously, imposes the obligation to respect that control. The situation is totally different in respect of limited property rights. The limited property rights entitle a person to exercise some rights, which are typically given to an owner, on another person’s thing. The right of transmission easement constitutes a special, separate type of easement and it limits the ownership. The introduction of that right was a legislator’s response to the postulates made by transmission entrepreneurs to regulate the use of the real estate on which distribution equipment has been or is planned to be constructed. The possibility to acquire transmission easement by acquisitive prescription still causes numerous disputes both in the doctrine and among legal practitioners. That claim raised by the entrepreneurs entails the necessity to prove that the transmission entrepreneur and their legal predecessors used another person’s real estate in exactly the same way as it would have been used by the person who is entitled to the transmission easement (from 2008) or to an easement analogical (similar) to the transmission easement (until 2008), namely by using permanent and visible facilities which in this case are designed to transmit electrical energy (energy transmission, equipment maintenance, checkups and repairs).</summary>

Abstrakt: This article is an analysis of the issue insurance risks from the point of view of the subjective scope, and of the mandatory crop insurance in the Polish legal system. The issues raised as an element of introduced within the framework of the Common Agricultural Policy for the years 2014-2020 of the system of risk management in agriculture determine the direction of the development of crop insurance as a tool for securing not only the interests of agricultural producers, but also entities in any way dependent on the economic situation of agriculture as a sector of economy. At the same time, the author points to the issues specific to individual insurance risks, as well as to questions of interpretation arising under these regulations. The author also draws attention to the achievements of home insurance legislation in the matter, reaching the beginning of the reborn Polish State, as well as the development trends in the market of compulsory insurance of agricultural crops in Poland, from the perspective of its functioning after Poland’s accession to the European Union.</summary>

Abstrakt: The article discusses the issues connected with the legal aspects of the risk management in agricultural production. It is based on US federal crop insurance system and its programs before and after the reinforcement of the Farm Bill in 2014. The paper presents the development of the insurances’ from the historical point of view and its premises in the scope of agricultural policy. Special attention is given to the basic insurance’s plans and their challenges arising from the regulations. In conclusion, the author attempts to evaluate the US insurance system and points out the differences in the relation to the Polish one. The federal crop insurance program is well-positioned today to promote resilient agricultural practices that mitigate the future impact of production risk.</summary>
