Umowa dożywocia i jej funkcja alimentacyjna

Abstract

Przedmiotem dysertacji jest analiza jurydyczna umowy dożywocia na tle jej funkcji alimentacyjnej. Praca przedstawia umowę dożywocia jako instytucję prawną, która w nowej rzeczywistości polityczno-gospodarczej ponownie zaczyna nabierać znaczenia w obrocie prawnym i przy właściwym sposobie ukształtowania praw i obowiązków stron umowy, może pełnić istotną rolę jako instytucja o charakterze alimentacyjnym, zapewniając dożywotnikowi wymagane na starość wsparcie. Pierwszy rozdział rozprawy doktorskiej ma charakter wprowadzający do problematyki dożywocia i jej funkcji alimentacyjnej. W tej części pracy omówiono chwila powstania stosunku prawnego dożywocia, forma i charakter prawny umowy dożywocia. W rozdziale drugim przedstawiono podstawowe założenia alimentacji w odniesieniu do umowy dożywocia. Przedmiotem rozdziału trzeciego jest problematyka zmiany treści i rozwiązania umowy dożywocia oraz ich wpływu na wypełnienie obowiązku alimentacyjnego. Część czwarta dysertacji obejmuje problematykę instytucji odwróconego kredytu hipotecznego i ocenę wypełnianej przez nią funkcji alimentacyjnej w odniesieniu do funkcji alimentacyjnej wynikającej z umowy dożywocia. Całość rozważań podsumowana została we wnioskach końcowych, które pozwoliły na stwierdzenie, że umowa dożywocia w obecnych realiach społeczno – gospodarczych ma szanse odgrywać istotne znaczenie w alimentacji ludzi starszych.

The subject of the dissertation is juridicial analysis of the annuity agreement associated with its alimony function. Paper presents an annuity agreement as a legal institution which in new political and economic reality again begins to gain importance in legal transactions. With proper way of shaping the rights and obligations of the parties of the agreement, it can fulfill an important role as an alimony institution, providing support for the annuitant required in his old age. The first chapter of the doctoral dissertation is an introduction to the issues concerning annuity agreement and its alimony function. In this part of the dissertation, a moment of creation of an annuity agreement, its legal character and form has been discussed The second chapter presents the basic alimony principles in reference to annuity agreement. The subject of the third chapter concentrates on the issues of changes in the contents of the legal bond and on the termination of the annuity agreement, as well as on their impact on the fulfillment of the maintenance obligation. The fourth part of the dissertation includes the issues concerning reverse mortgage and the assessment of the alimony function it fulfills in relation to alimony function of the annuity agreement The whole deliberations are summirised in the conclusion that led to the statement that the annuity agreement in the current social and economic reality has the potential to play a significant role in the maintenance of elder people.
